If the deceased individual would have been subject to pain and suffering prior to passing away, it may be possible to make a victim’s claim for compensation.

Dependent’s claim for compensation

If the victim of a fatal accident that occurred as a result of another individual’s negligence had dependents, they may be eligible to claim for continued financial support.

Those eligible for compensation include parents, grandparents, children and grandchildren.

The total compensation award would be scaled against the amount they would have received from the deceased individual if they were still alive.

Statutory award for bereavement

This is a statutory amount payable by the party at fault to the family of the deceased individual.  This amount can be received by the spouse, children or partner of the deceased.
