Product Liability Claims – Mobile


When buying an item from a manufacturer, retailer or supplier, the highest levels of quality are expected, no matter what product it may be.

If your purchase turns out to be unsafe or faulty and causes you an injury, you can make a product liability claim with Croftons Solicitors.

Compensation can also be claimed if a faulty product causes damage to your personal property, as long as the total cost of the damage suffered is £275 or more.

The Consumer Protection Act covers all consumer goods, including pharmaceutical products or medical devices.

For example, if an individual purchased a hair dye which caused them to suffer burns to the scalp, a hair and beauty claim could be made against the distributor.

Also covered are goods used in the workplace, which means you do not necessarily have to have purchased the faulty item yourself to make a claim.

A product is defined as defective if it did not meet the legitimate expectations of the user once purchased.

The way the product was marketed will be taken into account to help determine these expectations, and any accompanying instructions or warnings will be studied.

Making A Claim

Product liability claims must be made within three years of the date of the incident in which you were injured or your property was damaged.

The only exception to this rule occurs when it is only discovered a faulty product was to blame more than three years after the incident. In this scenario, the time limit reverts to three years from the date that the cause became known.

Unfortunately, any incidents which do not fall into this timeframe will be statute barred, and you will be unable to claim.
