Recovery of damages for Mr W of Lincolnshire, after suffering injury as a result of being provided with defective equipment by his former employers.
Mr W was employed as a driver and he had been asked to collect some cardboard bales by his employer. Mr W had been provided with some straps by his employer to secure the load so it would not move around in the vehicle whilst he was driving. The straps were, however defective and could not be used. As Mr W was driving this vehicle, the load in the back shifted to one side, causing him to lose control of his vehicle resulting in it turning over onto its side.
Mr W claimed that his employers were in breach of Regulation 4(1) of the Provision and use of Work Equipment Regulations 1998 for failing to ensure that the straps provided was suitable for the purpose for which they were used.
Mr W succeeded in his claim against his former employer and awarded the sum of £13,500 compensation for his injury and losses.
